The Artificial Intelligence Video Act is a bill passed by the State of Illinois that regulates employers utilising AI to evaluate video interviews of job applicants. The law applies to all employers that make use of an AI tool for the purposes of analysing video interviews of applicants for employment positions based in the State of Illinois. The key provisions include a requirement for employers to inform applicants about the use of AI and explain how it will be used to assess their suitability for a role. Futhermore, prior to conducting a video interview, employers must obtain the candidate's consent for AI evaluation. Employers can only share the video with those necessary for evaluation and are obligated to destroy all video copies within 30 days upon the applicant's request. The bill became effective on 1 January, 2020.
